Benavidez v. U.S., 177 F.3d 927 (10th Cir. 1999):
Tenth Circuit held a government-employed therapist can be held professionally negligent for providing drugs and alcohol to a patient and then initiating sexual conduct. A claim against the U.S. under the intentional tort exception to the Federal Tort Claims Act (FTCA) is not appropriate even though the government failed to conduct a background check to uncover the therapist's history of pedophilia.
